I think DA's non-sentence recommendation is a great and hard-fought victory for the Chinese community and a great news for Liang. This is an exceptionally good turning point for the case. While we disagree with DA's charges and the verdict, and firmly believe Liang is innocent, we should work with him and the judge to use the recommendation as a starting point in the sentencing phrase. Given the political environment we are in, in consideration of potential risks, uncertainties and complications of other alternatives (including appeal), this is a better than expected overall outcome.

Realistically, appeal is a prolonged process, full of uncertainties and with no guaranty of success. Not to mention the costs. On the other hand DA needs to have something to show to those above and behind him, and to his constituents. Practically Liang would be spared jail time and hardships. I think this is a win/win situation all the parties. Learning when to make compromise, political or otherwise, is important.

I'm not saying that this is the best we could get and that we should stop working on the problematic justice system. But I think this is a great starting point. I don't think, however, we should reject DA's gesture outright.

As a stating point, that's negotiable. It could be two or three years of probation, for example. But that's something Liang's attorneys can work out with DA. The current movement Liang's case has espoused, of course, can morph into a broader movement and continue.
