Now let me also just read a reference. The current law right now, current law authorizes the intent of the legislature that the UC and the CSU see to enroll a student body that meets high academic standards and reflects the cultural, racial, demographic, economic, and social diversity of the state of California, Education Code 66205. That’s written in our Education Code and the UCs need to have a diverse population. What does diversity mean? It means an enrichment in what we do and how we learn. California is the most diverse state in the United States of America, and if you read just, I believe, yesterday in the Sacramento Bee, it says that the Latino population is going to be surpassing and now has surpassed the white population. I also understand there’s concern about the mismatch effect. I am not saying we should or we should ever admit individuals of color who are not prepared to graduate. We should go after the best and the brightest and they are there. But the UCs don’t have the tools to go after those individuals. Let me just refrain and restate the four cases that were quoted earlier. It’s the Regents of the University of California versus Bakke, and it clearly states that racial quota is unconstitutional and I am not advocating a racial quota. What I am advocating is to allow the university systems all the tools in their toolbox to make sure that California has the most diverse state in the state of California.
燕子:the argument against Hernandez should center around his misleading point that UCs don't have the tools to go after the brightest. 1. UCs are already among the most diverse with various means to improve diversity (details in Jennifer Gratz's article 2/7). 2. Point out his faulty logic: if not mismatch, why use race as a criteria? . Use rhetorical questions such as "Aren't schools are to find the best, based on merit? How will using race help find the best?" 3. Use the Duke study to provide evidence that AA is shown to produce mismatch. Just saying his intention was not mismatch is not acceptable. Regardless of intention, the result already shows. He can't have both ways, which is hypocrisy. Just some quick thoughts.
qcai: I suggest using this argument. Diversity is a reasonable goal, but race is the wrong solution for it. California currently already uses many ways to balance diversity, why we have to use race? It sends the wrong signal to children, college student and young people. Bringing back race is the worst of all solutions.
