In response to press enquiries from various media organisations on an operation of the Independent Commission Against Corruption (ICAC) which caused wide public concern, the ICAC issued the following response in view of the public interest involved:
Upon receipt of corruption complaints alleging some Legislative Council (Legco) members of accepting advantages in breach of the Prevention of Bribery Ordinance (POBO), the ICAC has commenced an investigation. After gathering evidence and seeking legal advice from the Department of Justice (DoJ), the ICAC applied to the Court of First Instance for search warrants and a statutory notice under the POBO.
ICAC officers today (August 28) searched four premises in Hong Kong, including three residences of the persons involved in the case and the office of a Legco member at the Legco building. A statutory notice was also served to the Secretary General of a political party. No arrest was made during the operation. The investigation continues.
The ICAC stresses that as a law enforcement agency, the Commission investigates every case impartially, without fear or favour and in strict accordance with the law. The ICAC, as always, has no political consideration in enforcing the law. Today's operation was launched in view of the progress and the need of the investigation.
The ICAC will report the progress of this investigation to the Operations Review Committee, and will seek legal advice from the DoJ as and when necessary.
就多間傳媒查詢有關廉政公署(廉署)調查行動引起廣泛關注,基於公眾利益,廉署作以下回應:
廉署早前接獲貪污投訴,指控有立法會議員收受利益,涉嫌觸犯《防止賄賂條例》(《條例》)一事,廉署已展開調查,並就調查所得及徵詢律政司的法律意見後,向原訟法庭申請《條例》下有關的搜查令及法定通知書要求提交資料。
廉署人員今日(八月二十八日)先後搜查本港四處地方,包括三處與涉案人有關住址及一位議員立法會辦公地址,並向一位政黨秘書長發出有關通知書。在行動中廉署人員並未拘捕任何人士,調查現仍在進行。
廉署強調,作為執法機構,一如既往秉持不偏不倚辦事原則、依法公平及公正進行調查每宗案件。廉署在執法過程中從來不作任何政治考慮。有關行動是因應本案調查進展及需要而作出的。
就有關案件廉署會向「審查貪污舉報諮詢委員會」匯報調查進度,並在如需要時徵詢律政司的法律意見。
