What is C-279 all about?

C-279 法案到底是什么?

Randall Garrison, the LGBT critic for the NDP, introduced private member's legislation C-279, seeks to fight hate crimes against transgender individuals by adding gender identity to the Criminal Code and the Canadian Human Rights Act.

Randall Garrison, NDPLGBT同性恋评论员,提出私人成员的法案 C-279, 寻求对抗针对变性人的仇恨犯罪,在加拿大刑法和人权法中加入性别认同(gender identity).

gender identity” means, in respect of an individual, the individual’s deeply felt internal and individual experience of gender, which may or may not correspond with the sex that the individual was assigned at birth.  ( referred from Bill C-279 )

Please pay attention to the word "felt" used in the definition of "gender identity", which means as long as a person feels that he is one of the genders, there is no proof or commitment needed. Feeling is such a personal expression. Should a law be defined based on feeling? 

请注意在“性别认同”定义中使用的词“感觉”,也就是说只要一个人感觉TA是任何性别即可,不需要证明或变性承诺。感觉是一个非常个人化的词,难道法律可以跟着感觉走吗?

 

With Bill C-279, now sexual predators don't have to go to all the bother of disguising themselves as women: they can simply pretend to be trans males and walk right in to the women's bathroom.

 

有了 C-279 法案,性犯罪分子甚至不用那么麻烦地化装成女人,只要他们装成一个变性人就可以大摇大摆地走进女厕所。

Before the Commons vote in 2013, Conservative MP Rob Anders tabled a "petition" to protect and safeguard our children from any exposure and harm that would come from giving a man access to women's public washroom facilities". That's where the nick name "bathroom bill" for C-279 came from.

Someone may argue that there is no the word“bathroom”in the bill. Let's see what the advocacy group said about it.

有人说这个法案里面找来找去找不到“厕所”这两个字。那么让我们来看看赞成这个法案的人是怎么说的。

"but if it's going to have the amendment in it that restricts our use of washrooms and public facilities... no," said Amanda Ryan from the advocacy group Gender Mosaic. "It's a bad bill with that amendment in it. We want to fight as hard as we can to have that removed," she told CBC News Network's Power & Politics on Thursday.

If they had nothing to hide, if they had no intention to use the Bill C-279 for them to use bathroom, why would they say it's a bad bill WITH the amendment.  Apparently, the amendment pinpoints their hidden agenda and their real intention although they didn't put anything other than gender identity to the Criminal Codes.

 

如果他们没有什么东西要隐藏,如果他们没有要利用 Bill C-279 去用公共厕所的企图,那他们为什么说有了修正案这个法案就不好用了?很显然,这个修正案刺痛了他们隐藏的计划,揭露了他们真正的目的,虽然他们除了 gender identity 外没有任何其它东西加到犯罪法案中。

 

 

 

2. What is C-279 amendment?  什么是 C-279 修正案?

On Feb 25, 2015, Conservative Senator Don Plett  introduced amendments to the Bill C-279 that would limit that protection so that members of the transgender community would not be pretected in single-gender spaces, including bathrooms,changerooms, correctional facilities or shelters.

2015年二月25日,保守党参议员 Don Plett 提出了对C-279法案的修正案,旨在把对变性人团体的保护限制在单一性别的公共场所之外, 包括公共浴室,更衣室,监狱等之外。

 

Amendment to the bill C-279 is NOT the bill C-279 itself. It's the protection to the general public that Conservative Party introduced in Senate. Bill C-279 is initiated by NDP to promote transgender's interests. Often, people are confused between these two.

C-279 法案的修正案不是C-279法案的一部分,而是保守党为了保护广大群众提出的修正案。C-279 法案是由 NDP 提出的用来保护变性者利益的。大家很容易把这两个搞混淆。

In senate, Liberal party has been working to pass C-279 WITHOUT the amendment.  Conservative Party insists to pass C-279 with the amendment so general public's rights won't be triumphed by transgender's rights.

在参议院,自由党一直在努力同过没有修正案的C-279。保守党坚持C-279 法案必须有修正案的限制以保护大众的权利不受到变性者的侵犯。

 

 

3. Is C-279 necessary? Is transgender already protected under current law?

C-279 法案有没有必要?变性者是不是在现有法律下已经受到保护?

Conservative Senator Denise Batters asked Mr. Garrison whether current protections – against discrimination on basis of sex or sexual orientation, for instance – already protect the transgender community. Mr. Garrison acknowledged that he knew of no trans cases that were not able to proceed under those protections, but that having to argue a case through other channels created an unnecessary legal hurdle. The bill would remove that and also add a “public denunciation” of discrimination based on gender, he said.

保守党参议员 Denise Batters Garrison现有的法律,例如保护不因性别或性取向而受到歧视,是不是已经保护了变性者团体? Garrison回答说他还没有看到过现有法律不能保护变性者团体的例子, 但还辩论说通过其他法律很麻烦。这个法律就是要去除这个障碍,在歧视的定义中加入性别认同。

 

The initiator of Bill C-279 acknowledged that transgender community is protected under current laws. Then why it is necessary to introduce Bill C-279? What is the agenda behind that?

C-279 法案的提议者自己也承认现有法律保护变性者团体,那为什么还要提 C-279 法案?这个法案到底要干什么?

If Bill C-279 is passed in Senate without the amendments as Liberal Party so wished, then nobody would be able to question when a biological male enters women's bathroom because people won't be able to tell whether this biological male is a transgender or not from the looking until everything is too late and a crime is committed should that biological male is a sex predator. Otherwise, the person who questions will be considered discrimination and hate crime under Bill C-279 and may be prosecuted.

如果象自由党希望地那样通过没有修正案的 C-279,那么当你看到一个外表象男人的人走进女厕所时你就不敢去质问,因为光从外表你不能确定他是不是一个变性人,直到一切都太晚了,犯罪案件已经发生了。否则那个前去质问的人就可能因为 C-279 法案而被控犯有歧视罪和仇恨罪。

The Bill C-279 wildly opens the door for criminal with ambiguous wording "felt". Someone may argues that this is the implementation problem but not a law problem. Should a law may have such a problem to be implemented, it should be amended to be less ambiguous and has less problem to be implemented. You can't pass a law with the provision that it could causes big problem to be implemented but you still pass it and wait until problem comes and solve it after. 

C-279 用了“感觉”这个词为性犯罪者大开了方便之门。有人会说这是执行的问题,不是法律本身的问题。当一个法律可以预见会有执行上的问题时,难道法律本身就不应该修正以减少含糊不清的定义和执行上的问题吗? 当你知道法律的执行会有问题时,难道你还是要去执行,直到出了问题再来解决吗?

There are so many cases already that sex predator enters women's bathroom. Why would we introduce a law that would facility them? Why promoting transgender community right should sacrifice majority other people's right?

已经有太多性犯罪人员进入女厕所,为什么还要通过这样一个没有必要的法案去为他们大开方便只门呢?为什么在宣扬变性者团体的利益是要牺牲大多数人的人权呢?
